California Senate Unanimously Supports AB 831 to Ban Sweepstakes Casinos
The California Senate has reached a unanimous decision to pass AB 831, legislation aimed at prohibiting sweepstakes social casinos within the state. Supporters of the bill argue that these platforms function as illegal gambling operations, justifying the measure.
Controversy Surrounding the Legislation
The discussion over sweepstakes casinos has divided opinions nationwide. Some tribal operators and industry advocates defend these businesses, highlighting their contribution to state tax revenue and their role in fostering innovation. In contrast, critics view sweepstakes casinos as a loophole used to evade regulations and avoid paying proper taxes.
Legislative Process and Industry Response
While the sweepstakes sector has expressed willingness to collaborate with lawmakers to update regulations, it warns that an outright ban could drive millions of recreational players towards unregulated and potentially unsafe alternatives. Following the Senate’s approval, AB 831, introduced by Assemblymember Antonio Valencia, now proceeds to the California Assembly for further review. Governor Gavin Newsom has not publicly indicated whether he would approve or veto the bill.
The Social Gaming Leadership Alliance (SGLA) has publicly criticized AB 831, labeling it as a proposal rooted in populist sentiment rather than factual analysis.
Concerns Over Impact on Industry and Tribal Communities
Jeff Duncaun, executive director of SGLA, cautions that if the bill becomes law, it could unfairly target legitimate businesses and strengthen the dominance of powerful interests in California’s gaming sector. He further contends that the legislation could harm economically disadvantaged tribal communities by removing important economic development opportunities.
He stated, “This bill threatens legitimate businesses with criminal penalties, undermines key opportunities for tribal development, and overlooks the potential for responsible regulation to generate significant new tax revenue. We urge lawmakers to reject this misguided bill and support fairness, innovation, and tribal autonomy.”
Potential National Implications
If AB 831 is enacted, California would join New Jersey as one of the few states to outlaw sweepstakes casinos. Similar legislative efforts are ongoing in New York, where Governor Kathy Hochul is considering related measures.
Additionally, various reports indicate that many participants in sweepstakes platforms engage primarily to win real cash prizes, challenging claims that users are motivated solely by entertainment.
