An amendment was introduced to the Provisional Measure that modifies the sports betting law in Brazil

(Brazil).- Senator Rose de Freitas (MDB-ES) presented Plenary Amendment to Provisional Measure 1034/2021, modifying Chapter 30 of Law No. 13,756 / 2018, which deals with the percentages practiced by rate bets fixed or sports betting.
According to the proposal, all legal beneficiaries will be eliminated, leaving only the destination for the payment of the contribution to social security that taxes the product of the collection at the following rates: 0.25% for the case of bets in physical media and 0.125% for the case of bets in virtual media and for the payment of the income tax of the prize. The rest will be used to pay premiums and finance the operation.
According to Rose de Freitas, PLV 12/2021 of Provisional Measure 1034/21, in its art. 6, significantly alters the legal framework of the “Fixed Fee Betting” lottery modality, making it more attractive to investors, but that “This attractiveness, however, cannot be sculpted at the expense of Social Security (health, well-being and social care)".
Likewise, according to the deputy, although it does not modify the calculation base of the Social Contribution on Income from Forecasting Contests, the PLV reduces the rates to one-fifth of those provided for in Law No. 13,756, of December 12, 2018. Thus, the rate applicable to bets on physical media falls from 0.5% to 0.1%, and that applicable to bets on virtual media falls from 0.25% to 0.05%.
"This reform restores said rates to half the percentages provided in Law No. 13,756, of 2018: 0.25% (twenty-five hundredths percent) on bets on physical media and 0.125 (one hundred and twenty-five thousandths percent) applicable to bets in virtual media. Social Security is a patrimony of the Brazilian nation and must be preserved", justifies Senator Rose de Freitas.
