WHAT’S HAPPENING IN ONLINE GAMBLING?
Our industry has got a fresh report straight from the European Commission on Enforcement and Online Gambling. This report addresses the challenges which arise when member states seek to enforce national restrictions on the provision of the remote gambling services. During the discussion panel on July 17th, authors of the report will discuss its key findings and potential implications with experts in the field. Endorphina’s Head of Legal is joining the discussion as a representative of the software game provider (Endorphina) and will provide his thoughts and reflections from the point of view of B2B suppliers.
WHY IT IS IMPORTANT
One part of the report reflects on software providers and elaborates on possibilities of enforcing the restrictions against illegal operators. Though the idea sounds very reasonable, as it often happens in legislation, there will always be other meanings hidden in the details. And this is what will be discussed to make sure that everyone fully understands and is on the same page.
“I do believe that enforcement against illegal operators not only within the member states of EU and EEA should be more effective, but there are too many questions”, - Jakub says. “Approaching the software providers for the purpose of blocking illegal or unlicensed operators could be a powerful tool but it must be used wisely. It is necessary to define the exact borders of responsibility for software providers. For instance, it could be illegal for an operator to operate in a certain jurisdiction but at the same time it does not mean that the same restriction goes to the software provider as well.”
“We need to define borders and the mechanics of the law enforcement process. We should come up with a specific definition of “illegal operators” and possible liabilities towards game suppliers ideally on a multi-jurisdiction level.”
