This PGS conference under the title Regulation of Remote Gaming in Peru, Strengths and Opportunities was presented as a dialogue between Gonzalo Pérez, CEO of Apuesta Total representing the business vision of the gaming world in Peru and on the regulatory side the leader of the General Directorate of Casino Games and Slot Machines of Peru Yuri Guerra Padilla, whom moderator Carlos Fonseca of Estudio Fonseca defined as “the best public official in Latin America who knows the technical issues of gambling activities.”

To begin, faced with the question, what are the advantages and differences of Peru's regulatory system with the rest of Latin America?  Yuri responded that “this regulation was treated on in the private sector and the public sector. Another advantage is that it has a regulator at the national level compared to other countries in which they have to submit an application for each of the provinces or regions that may exist. It also has a modular design, this means that I can obtain a base platform, a number of providers, I can change platforms, I can change providers. In some ways it is totally dynamic, totally flexible and I think it makes the market much more competitive. In addition, each of the actors has been identified and given the corresponding role, the responsibility that corresponds to each of them.”

He also highlighted how “Another advantage of Peruvian regulation is the knowledge and maturity that both the regulator and you, a private company, people who come to invest in the country have. And we as a regulator are the ones who give the support and solidity that the law and the State have to give to those businessmen who invest in the country. And that's what we do".

To this, Pérez agreed that "as Yuri explained, the fact that it is a regulation that is going to remain open, is not that like in other jurisdictions it is going to be limited to a number of operators, here it is going to remain open and there is no no project, no idea that is going to be closed. Which from the operator's point of view is quite important, because perhaps someone might think, why not limit it? But from my perspective I think that competition is super healthy and super important and allows us to achieve better things.”

Then came the question of what can the public sector do for the private sector to ensure the protection of the public interest and the integrity of the gaming industry? In this sense, Yuri highlighted that “As a regulator, what we basically have to do is prevent the issue of illegal gambling. That is a main activity that we have as a regulation area, as an inspection area. But as for the investment coming to the country, it is basically its doors open to everyone, listening to each and every one of you, trying to find alternative solutions, looking for the best for the country, in establishing completely clear requirements through of mandatory directives, establish, for example, if there were a greater amount of technology, through directives, regulate it, make Peru a competitive country that attracts investment, because that generates employment and development at the technological level, employment generates that families have a fair job, a decent job, a salary to take home.”

For his part, Pérez stressed that “from the private sector, what we definitely have to do is maintain this close relationship with the regulator through training. We all know here from the operator's point of view that different gaming modalities are constantly emerging and unfortunately no law or regulation will ever keep up with the speed with which things come out" and he added "The problem is that “When something happens that can affect the industry, that is where we normally feel unprotected because it is such a technical issue that many times people do not understand it.”

He also added “I think that the role we have to play, what we talked about a little, is to demonstrate to society that we are doing things well, with clear regulation that also allows us to collect taxes, that protects vulnerable populations such as minors. age or people with gambling addiction. I think it is an arduous task, which also has to be done with tweezers, because it is not just going out and saying, the game is nice, everyone play.”

In response to the moderator's comment on the topic of responsible gaming Yuri responded “We in the General Directorate have a registry of people who are prevented from entering both the physical rooms and now the virtual world. What we have generated for you are services, some links so that you can automatically have the information and can block these people, as well as those minors who want to enter. That is why the regulation establishes that there is no anonymous game to be able to identify this vulnerable group” and added “But not only does the regulation stop at that, it also creates the issue of the tax. Within the tax there is 20% that for the first time in history goes to the issue of mental health, that support to those people or those children who need this issue of psychological support. The tax, also as part of what you are going to deliver, 40% goes to the development of the tourism sector.”

To which Pérez completed that “in this fight against illegal gambling, as we have also discussed at some point with Yuri, essential allies are going to be the providers of the game content, the payment gateways, especially the leaders, because definitely what What a player wants is to play, and to play they will choose the best games and need means of payment. Then the law itself and the regulations establish that linked service providers have the obligation to offer their services to licensed operators.”

Finally, and as a pending issue, they explained that “We still do not have the standard for preventing the money laundering system. We are already working with the FIU, and we consider that suddenly the rule will be released by the month of August. It is very similar to Almost No Coin Swallowing, and some small adjustments will be made, in reality it will be the same rule for everyone. I think this gives the banking and insurance sector a little more peace of mind, but what they have pointed out is that for them it is a guarantee, if the company already had authorization from the Minsetur, so that the risk is minimized. .
