The Federal Government brought an interlocutory appeal against a decision granting an interim injunction in favour of Tropicalize Participações e Investimentos Ltda, allowing it to continue operating fixed odds betting without paying the required fee. The contested decision ordered the judicial deposit of the amount of R$60 million, corresponding to two betting licences, and guaranteed the company's inclusion in the list of authorised companies on a provisional basis. 

In its appeal, the Federal Government argued that the injunction violated the regulatory framework for fixed-odds betting in Brazil, established in Law 14.790/2023 and regulated by the Secretariat of Prizes and Betting (SPA/MF) of the Ministry of Finance. According to the Office of the Attorney General of the Union (AGU), the company was regularly notified through the Betting Management System (SIGAP) to pay the licence fee, as provided by law, and that there is no illegality in the procedure adopted by the Public Administration. It also argued that the complainant had already received and responded to previous notifications through the same system, which shows that it was aware of the electronic process.

The Federal Government also pointed out that the allegation of technical difficulties in issuing the payment voucher is unfounded, as the legislation establishes clear and non-extendable deadlines for the payment of the fee. It also argues that the company, by not paying on time, is improperly requesting an extension that has no legal support.

The Federal Government's petition requested the annulment of the injunction on the grounds that it creates an irreparable risk to the regulation of the sector, endangering the supervision and control of gambling activities in the country. It also alleged that the maintenance of the measure undermines the isonomy between the companies in the sector, unduly favouring the aggrieved party to the detriment of the other operators that have complied with the legal requirements.

With the suspension of the first instance decision, Tropicalize Participações e Investimentos Ltda, which operates the betfive.io, sportsbet.io and b2xbet.net brands, and jetbet365.com, sorte.bet and pinbet.io were excluded from the list of companies authorised by the Secretariat of Betting and Prizes of the Ministry of Finance - SPA/MF to offer fixed odds betting throughout the national territory by court order.

Companies authorised by decision of the Federal Court

Currently, the Secretariat of Betting and Prizes - SPA/MF of the Ministry of Finance has already been forced to authorise the operation of six companies and 13 brands/domains due to decisions of the Federal Court.

The companies Select Operations Ltda (mmabet.com, papigames.com and in2bet.com), Megapix Comunicação e Tecnologia Ltda (megapix.bet), Zona de Jogo Negócios e Participações Ltda (zonadejogo.com, apostaonline.com and onlybets.tv), Cash For Pay Ltda (betmillion. io) were authorised by Federal Judge Itagiba Catta Preta Neto of the 4th Federal Civil Court of the Federal District Judicial Section and Atlantis Comercio Eletrônico e Software House Ltda (MetBet, EsportivaBet and MetGol 100%) by the Federal Judge of the 2nd Federal Court of the Federal District, Sergio Wolney de Oliveira Batista Guedes. Esportes Gaming Brasil Ltda (Esportes da Sorte and Onabet), on the other hand, was authorised through a judicial process that is being kept secret.

So far, the SPA/MF has issued 49 definitive and 21 provisional authorisations. There are currently 77 authorised companies and 79 operating licences for fixed odds betting and online gaming, 71 of which are regular and six by decision of the Federal Court, making a total of 172 brands.
