(Malta).- Malta implemented its revised VAT and gaming tax frameworks for the gaming sector on 1 October 2026, introducing a coordinated package of reforms aimed at providing greater clarity, predictability and efficiency for operators. The changes, introduced through Legal Notices 84 and 86 of 2026, revised the tax treatment of certain gaming services and consolidated elements of the existing gaming tax structure.

The revised VAT framework implements changes to the treatment of certain gaming services, including sports betting and specific casino offerings. It also clarifies the application of the relevant place of supply rules for these activities.

Another element of the revised framework concerns the recovery of eligible input VAT costs where applicable. The changes are intended to give gaming operators greater clarity when determining the VAT treatment applicable to their services and related business activities.

The implementation followed extensive engagement between the Maltese authorities and representatives of the gaming industry. The reforms formed part of the Government of Malta’s commitments announced in the 2026 Budget, which included measures aimed at safeguarding the long-term sustainability and competitiveness of Malta’s gaming sector.

For operators, the revised VAT framework implements a more defined approach to several areas that had previously required interpretation of the applicable tax rules. The changes therefore form part of a broader effort to establish a more predictable regulatory and fiscal environment for gaming businesses operating in or from Malta.

Revised Gaming Tax Framework Consolidates Charges

Alongside the VAT changes, Malta implemented a revised gaming tax framework covering qualifying gaming activities offered to players present in the country.

The new framework introduces simplified gaming tax rates for qualifying activities and consolidates the existing gaming tax and gaming device levy into a single structure.

The consolidated approach is based on the type of game and the mode in which the gaming activity is offered. This represents a structural change to the way applicable gaming-related charges are organised under the Maltese framework.

The revised system is designed to simplify the existing structure while maintaining a framework that distinguishes between different types of gaming activities.

The VAT and gaming tax reforms were developed in tandem, with the authorities seeking to implement a coordinated approach across both areas of taxation.

According to the Malta Gaming Authority (MGA), the reforms form part of a broader framework intended to maintain Malta’s position as a stable, competitive and internationally recognised gaming jurisdiction.

Authorities to Provide Guidance to Operators

The Malta Tax and Customs Administration (MTCA) and the MGA will continue to provide relevant guidance to stakeholders following the implementation of the revised frameworks.

This guidance is expected to support licensees and other affected stakeholders as they adapt their reporting and compliance processes to the new requirements.

The implementation of the reforms also includes a transition period for regulatory reporting, allowing licensees to complete obligations relating to reporting periods that began under the previous regime.

New Reporting Portal Timeline

The regulatory reporting Portal continued to accommodate submissions relating to the September 2026 reporting period under the previous framework.

Licensees must submit their September reports by 20 October 2026, with those submissions continuing to follow the requirements applicable to that reporting period.

The Portal functionality required to support reporting under the revised VAT and gaming tax frameworks is scheduled to become available by 1 November 2026.

Consequently, submissions covering the October 2026 reporting period will be made through the updated Portal and under the new reporting requirements implemented as part of the revised legislative framework.

Those October submissions are due by 20 November 2026, marking the first reporting cycle in which licensees will use the updated Portal functionality for the revised VAT and gaming tax framework.

The transition therefore separates reporting obligations associated with the previous and revised regimes, giving operators additional time to prepare for the new requirements while the updated reporting infrastructure is introduced.
