(Lima).- Peru's Ministry of Foreign Trade and Tourism published a regulatory project that seeks to modify the regulations of remote sports games and betting. The initiative aims to strengthen supervision, establish clearer criteria for the application of fines and strengthen the protection of users against illegal gambling.
A proposal to strengthen the regulatory framework
The Ministry of Foreign Trade and Tourism of Peru (Mincetur) ordered the publication of a draft supreme decree that modifies the regulations of Law No. 31557, which regulates the exploitation of remote gaming and remote sports betting. The current regulations were approved by Supreme Decree No. 005-2023-MINCETUR.
The initiative, authorized by Ministerial Resolution No. 382-2026-MINCETUR, seeks to improve the clarity and predictability of the regulatory framework applicable to authorized operators, through the more precise definition of their obligations and prohibitions.
The draft and its explanatory memorandum will be available for 15 calendar days to receive comments and contributions from public and private entities, civil society organizations and interested citizens.
Oversight, audits, and operating conditions
Among the main objectives of the reform is the strengthening of Mincetur's supervision and oversight mechanisms. To this end, adjustments are proposed in different operational provisions related to the transmission of information, audits, guarantees and the conditions required to obtain and maintain the corresponding authorisations.
The proposal also contemplates expressly regulating the procedures for declaring the abandonment of confiscated property, as well as establishing the conditions for its disposal and destruction.
These amendments seek to bring greater clarity to administrative procedures and facilitate the application of the rules governing remote gaming and sports betting technology platforms, as well as sports betting rooms.
Objective criteria for the application of fines
Another of the central points of the project is the incorporation of objective criteria to graduate and impose economic sanctions on operators.
The purpose is to promote a more coherent, proportional and effective application of the regulations, providing greater predictability on the consequences of regulatory non-compliance.
According to the foundations of the initiative, these measures also seek to strengthen the protection of users, combat illegal gambling and safeguard the public interest.
How to submit comments to the project
Those interested may send their observations and proposals through the institutional portal of Mincetur, through the entity's parties table, located at Calle Uno Oeste Nº 050, Córpac urbanization, district of San Isidro, Lima, or by email to apuestasdeportivas@mincetur.gob.pe.
The General Directorate of Casino Games and Slot Machines, under the Vice Ministry of Tourism, will be responsible for receiving, systematizing and analyzing the contributions submitted during the consultation period.
The process will allow for input from different sectors before moving forward with proposed changes to Peru's remote gaming regulations.
