Regulation of Online Casinos in Argentina: a long road to go in constant development

(Buenos Aires, SoloAzar Exclusive).- Argentina is one of the Latin American countries with notable growth in the online gaming industry. However, the development of its regulation has been a complex process, which began to take shape in 2016 and promises significant progress in 2025. This report analyzes the history, the legal context and regulatory changes with the aim to formalize a stricter online gaming regulation in the country.

Regulation of Online Casinos in Argentina: a long road to go in constant development

The Starting Point: National Gaming Law of 2016

In 2016, the National Gaming Law marked a before and after for the gaming industry in Argentina. Although it is strongly prohibitive, its main focus was on traditional and in-person games, this regulation established the bases for the control of the activity at the national level.

Among the key points of this law we find:

-Recognition of regional powers: Each province acquired autonomy to regulate games of chance in its jurisdiction.

-Focus on the prevention of gambling addiction: Initial measures were introduced to promote responsible gambling.

-Taxes on the sector: Although not directly aimed at online gaming, the law established a tax framework that would later serve to regulate this modality.

First Advances in the Regulation of Online Casinos (2018-2021)

The rise of online casinos during these years prompted provinces to take specific measures. The city of Buenos Aires led the way, implementing a legal framework in 2019 to authorize and supervise online gaming operators with Provincial Law 15,079. Provinces such as Mendoza, Córdoba and Santa Fe followed, which began to adapt their regulations.

However, despite these advances, the national landscape remained fragmented, with marked differences in tax requirements and rates between jurisdictions. This generated challenges for international operators interested in entering the Argentine market.

Four key objectives of the Reform

1. Unification of the regulatory framework: Although the provinces will retain their autonomy, they seek to establish common minimum guidelines at the national level.

2. Greater control over operators: Stricter licensing requirements will be implemented, ensuring that operators comply with international standards.

3. Gambler protection: The reform includes specific measures for the prevention of gambling addiction, such as self-exclusion and educational campaigns on responsible gambling.

4. Combat illegal gambling: The development of technological tools will make it possible to identify and block unauthorized websites operating in the country.   

Economic and Social Impact

With these measures, the online gaming market in Argentina is expected to grow in an orderly manner, generating significant tax revenues that can be allocated to social and health programs. Likewise, it seeks to reduce the risks strongly associated with unregulated gambling, such as fraud and addiction.
