Supreme Court to Hear DK Gambling ApS Bankruptcy Case Over Player Funds

(Denmark).- A recent High Court ruling has determined that player funds held by the bankrupt operator DK Gambling ApS are specially protected, granting players priority over other creditors. 

Supreme Court to Hear DK Gambling ApS Bankruptcy Case Over Player Funds

This decision, which reversed a previous lower court ruling, is now making its way to the Supreme Court, with the Danish Gambling Authority stepping in to back the player.

The High Court's Landmark Decision

On November 13, 2025, the High Court issued a verdict regarding a player's right to access money stored in a gaming account with the insolvent DK Gambling ApS. The court sided with the player, establishing that these funds enjoy special protection during bankruptcy proceedings. Consequently, the player has a "right of separation," meaning their claim supersedes those of the estate's general creditors.

This judgment successfully overturned the prior ruling made by the Maritime and Commercial High Court. Following this legal defeat, the bankruptcy trustee requested—and ultimately received—approval to escalate the matter to the Supreme Court for a final say.

Background and Upcoming Supreme Court Clash

The origins of this legal battle date back to April 2022, when DK Gambling ApS officially entered bankruptcy proceedings. The estate's trustee initially denied players access to their account balances, arguing that the gambling legislation did not actually afford these funds any special protection. In response, a player initiated a lawsuit to secure their money ahead of other creditors, prompting the Danish Gambling Authority to intervene and support the player's interpretation of the law.

The final showdown is now slated for March 10, 2027, at the Supreme Court. During this hearing, the Danish Gambling Authority will once again participate to officially advocate for the player's claim and the protection of player funds.
