Peru: Online betting houses have until March 13 to request authorization to operate

The Minister of Foreign Trade and Tourism, Juan Carlos Mathews, announced that companies that offer remote sports betting and gaming services must virtually present their application to be granted operating authorization from Tuesday, February 13 until on Wednesday, March 13. These types of companies will begin to pay a tax of 12% of their net profit.

This is important news: putting Law No. 31557 and its regulations into operation will allow regulating the exploitation of remote gaming and remote sports betting, generating a regulated economic movement with payment of taxes. And, above all, provide security for the bettor, responsible gaming and the formalization of the activity,” indicated the head of Mincetur.

The entity specified that registration is essential for companies to offer their services in the country. Otherwise, they will be subject to a penalty of no less than S/772,500 (150 UIT) and, in addition, to a criminal complaint and disqualification from carrying out activities.

The minister explained that a “white march” – that is, a pre-registration – is currently active, in which certification laboratories, companies that offer remote gaming and remote sports betting, and service providers can enter. your data.
This will allow adequate operation of the Mincetur computer system, by addressing all the requests that begin to be received as of next February 13. To access this prior registration, interested parties must enter the following link: https://extranet.mincetur.gob.pe/extranet2/Home/Inicio.

“This will be important, because 115 companies have been identified that have been offering remote gaming and sports betting services in the country, of which 86 are non-domiciled and 29 are Peruvian. This marks the clear vision of responsible gaming and strict compliance with the law and its regulations,” the official emphasized.

From when will online betting houses start paying taxes?

Once the companies meet the requirements and are authorized by Mincetur, this is from April 1, they will be subject to the taxes. Thus, it is estimated that, by virtue of this norm, the Peruvian State will be able to raise close to S/162 million annually, an amount that will be invested in the reactivation of tourism, tourist infrastructure works, promoting sports and addressing mental health programs. This will not affect betting or the payment of prizes.

What is Law No. 31557 about?

The law that regulates the exploitation of remote gaming and sports betting indicates, among various aspects, that the Mincetur is the administrative authority at the national level that regulates, authorizes, revokes, supervises and sanctions the exploitation of remote gaming and sports betting. from distance.

The legal device maintains that only those natural persons of legal age, of Peruvian or foreign nationality, previously registered on the technological platforms for remote sports betting or games authorized for exploitation by Mincetur, may participate in this activity.

In the case of remote sports betting gaming rooms, these may be located in a location exclusive to this activity or others whose main purpose is the sale of other products or services.

Regarding betting, the new law indicates that the player must pay for his bets with currency, credit cards, debit cards or any other means of payment, with the exception of cryptocurrencies.

In the case of obtaining prizes, these may be collected by the payment method that the player chooses or, failing that, through an account in his name, opened in a company in the financial system under the supervision of the SBS.

It should be noted that only those sporting events that are part of national or international associations, federations or sports leagues can be subject to sports betting.
