Peru: Mincetur pre-publishes regulations of the Law that regulates games and remote sports betting

(Lima).- The Minister of Foreign Trade and Tourism (Mincetur), Roberto Sánchez, announced that the draft regulation of Law No. 31557 has been published, which regulates the exploitation of games and remote sports betting, and that it will allow initiate tax collection in this activity.
In this way, in order to guarantee transparency and access to the regulatory proposal, the General Directorate of Casino Games and Slot Machines of the Mincetur has presented the pre-regulation, within the framework of the Regulatory Public Consultation, in order to ensure the participation of those interested in the matter, and thus, they can present their comments, suggestions and opinions.
“We have not waited for the established deadline to end. Now, for 21 days, the pre-regulation is available to all the actors and operators in the field, so that they can receive feedback, dialogue and have their suggestions”, stressed Minister Sánchez.
The Mincetur reported that the text of the pre-regulation has 53 articles that range from general provisions, activity authorizations, technological platforms, certification laboratories, supplier registration, and more.
Law that regulates sports betting and remote gaming
Remote gaming and sports betting activity in our country generates around US$1,000 million each year without paying the Special Gaming Tax (12%), as casinos and slot machines have done for 20 years. Therefore, the Mincetur worked on a bill that allows its regulation and formalization.
Thus, the Executive presented the project to the Congress of the Republic, an entity that added two opinions: one from the Economy Commission (which fell on Bills 168 and 1923) and another Opinion from the Foreign Trade and Tourism Commission (on the basis of Bill 2070 presented by the Executive, to which Bill 2206 was added).
After being approved in the plenary session of Congress, the government promulgated the Law on August 12 in a ceremony held at the Government Palace. The norm will allow the State to collect S/ 160 million annually, which will be invested in the following way: 20% will go to the public treasury; 40%, to the development of tourism; another 20% will go to mental health promotion; and the remaining 20% to the treasury.
