While these platforms argue their offerings are simply federally regulated financial derivatives, state lawmakers and the traditional betting industry are raising major red flags regarding consumer protection, lost tax revenue, and operating in a legal gray zone.

The Federal vs. State Jurisdiction Clash

In states like Maryland, prediction platforms such as Kalshi and Polymarket are trying to convince lawmakers that their sports and political contracts are federal commodities, not gambling. Local authorities aren't buying it. This discrepancy has already triggered severe actions, highlighting the understanding of regulatory challenges; in Tennessee, regulators issued cease-and-desist orders against these platforms, setting off a fierce legal battle in federal courts.

The core issue is that traditional sportsbooks answer to state gaming commissions specifically designed to oversee betting. In contrast, prediction markets operate under the Commodity Futures Trading Commission (CFTC)—a federal agency built to regulate wheat futures and interest rates, which is now scrambling to handle the explosion of sports-related contracts.

Understanding Consumer Safety and the Risk of Frozen Funds

For the average user just looking to place a bet, this jurisdictional tug-of-war has very real consequences. At a licensed Maryland sportsbook, player deposits are segregated, payouts are constantly audited, and there is a clear customer support process if a withdrawal gets flagged.

Prediction markets lack this safety net. Their unstable regulatory ground means that if a state issues a cease-and-desist order, contracts can be frozen in an instant. A user could find their funds locked up for weeks with no customer service rep able to resolve the issue, simply because the platform itself is tied up in legal disputes. 

Faced with this reality, many bettors prefer to eat the standard margins of regulated sites, understanding the risks involved, in exchange for the absolute guarantee that they can withdraw their money.

The Economic and Tax Impact on States

Beyond the debate over consumer protection, there is a crucial economic factor: tax revenue. Maryland has had a mature, legalized sports betting market since 2022, generating consistent tax revenue that the state can track, audit, and reinvest.

Because prediction markets shield themselves under the umbrella of federal derivatives, they contribute nothing to state treasuries—a massive sticking point for local lawmakers. While it is highly unlikely these platforms will disappear given their massive trading volumes, the coming months will be defined by more state interventions and court rulings. For bettors right now, the choice is simple: a regulated site offers state-backed support, while a prediction market offers a stake in an active federal lawsuit.
