Advertising and gambling: the ANJ and the ARPP sign a partnership agreement to strengthen their cooperation

(France).- Isabelle FALQUE-PIERROTIN, President of ANJ ( Autorité Nationale des Jeux), and François d'AUBERT, President of the ARPP (Autorité de régulation professionnelle de la publicité), have signed an agreement to strengthen cooperation between their two institutions, with the aim of promoting effective regulation of gambling operators' advertising.
This agreement comes after very fruitful exchanges over the last three years, in the direction of a convergence of the respective doctrines in terms of advertising for gambling and games of chance.
It is in this spirit that the ARPP (Autorité de régulation professionnelle de la publicité) recently updated its "Gambling" Recommendation adopted in 2009 to take account of the ANJ's (Autorité nationale des jeux) guidelines of 17 February 2022 relating to commercial communications by gambling operators.
The purpose of this partnership agreement is to go even further and strengthen operational cooperation between the ARPP and the ANJ, with the aim of deepening exchanges between the two authorities and promoting effective regulation of the commercial communications of gambling and chance operators.
This agreement is based on five key points:
Clarification of respective roles: the ARPP is the first point of contact for gambling operators regarding their commercial communications projects prior to distribution;
Sharing points of view: the ARPP may approach the ANJ to share its analyses and obtain its opinion when it has doubts about the compliance of a commercial communication project, while respecting the confidentiality of the projects submitted to it;
An exchange of information: when the ARPP is informed that a complaint has been lodged with the Jury de Déontologie Publicitaire concerning a commercial communication in favour of the gambling offer of a legally authorised operator, it informs the ANJ. Reciprocally, the ANJ informs the ARPP when the withdrawal of a commercial is being considered;
The creation of an annual observatory, as part of which the ARPP and the ANJ can discuss the major advertising trends and emerging commercial practices of operators;
Regular collaboration with a view to creating or improving support tools for operators (for example, the "gambling" module of the Responsible Influence Certificate).
The effective implementation of this agreement should help to promote moderation in gambling advertising in the run-up to major sporting events in the coming months, in particular the Rugby World Cup and the 2024 Olympic Games.
