Brazil: Normative Instruction for online gambling operators to submit certifications published

(São Paulo).- The Secretary of Prizes and Gambling of the Ministry of Finance (SPA/MF) published on Tuesday 14 in the Official Gazette of the Union (DOU) the Normative Instruction on the presentation of technical certificates by provisionally authorised fixed-odds betting operators and establishes a model of cover page and index for technical certificates, including for fixed-odds betting operators that are definitively authorised.
The regulatory instruction - IN (SPA/MF nº 3/2025), signed by the Secretary for Prizes and Gambling, Regis Dudena, provisionally resolves the ‘overbooking’ of the six certification laboratories recognised by the SPA/MF which have not been able to deliver several certificates to operators. In fact, two operators claim that the idea/suggestion to create this certificate came from the GLI to the SPA/MF in order to extend the services provided by the certifying laboratories.
Currently, the SPA-MF, at the suggestion of the laboratories, requires five certification documents: Betting System, Sports Betting, Remote Gaming Server (RGS), Integration Certificate and Online Gaming - RNG. Operators told BNLData that some of these certificates were suggested to the government by representatives of the laboratories themselves and not used in other jurisdictions.
Betting System Certificate; the name of the document must expressly state the type of certificate: Betting System - [Platform Name]; Sports Betting, if applicable; Remote Gaming Server (RGS), if applicable; Integration - [Platform Name]; and Online Gaming, if applicable.
According to the text of the regulation, fixed-odds betting operators authorised on a provisional basis must submit, by 30 January 2025, through the Betting Management System - SIGAP:
I - the technical certificates of the Betting System, the Sportsbook/Remote Gaming Server (RGS) and the Integration, covered by points 1, 2 and 4 of Annex VI of the SPA/MF Ordinance No 300 of 23 February 2024; and
II - a single online gaming certificate, referred to in point 3 of Annex VI of the SPA/MF Ordinance No 300 of 23 February 2024, or a single online gaming certificate referring to the games of a given provider.
The certificates shall be issued by a certification body whose operational capacity has been recognised by the Secretariat for Prizes and Gambling of the Ministry of Finance.
The submission of the Sports Betting Server and Sports Betting integration certificates to the platform is exempted for fixed odds betting operators who have applied to operate online games only. Remote Gaming Server (RGS), online gaming and RGS integration certificates are exempted from submission to the platform for fixed odds betting operators who have applied to operate only sports betting.
Certificates must be submitted through the Betting Management System - SIGAP, observing the following provisions: the document type Betting System Certificate must be selected; the document name must expressly indicate the type of certificate: Betting System - [Platform Name]; Sportsbook, if any; Remote Gaming Server (RGS), if any; Integration - [Platform Name]; and Online Games, if any. All documents must be submitted in Brazilian Portuguese.
In the event that the Sportsbook and Remote Gaming Server (RGS) certifications are included in the Gaming System certificate, the information on these servers must be clearly identified in the Gaming System certificate, as well as in the General Index Document provided in the Regulatory Instruction.
The Remote Gaming Server (RGS) certificate may be replaced by a certificate certifying remote access to the online gaming aggregator server.
In cases not covered in the previous sections, the integration certificates shall, where applicable, clearly identify the information relating to the integration with the operator's platform: Sportsbook Server; Remote Gaming Server (RGS), for online gaming providers; and the online gaming aggregator server, with the respective integration of the aggregator's system with the provider's system.
In the event that a single integration certificate is not issued per platform, the information relating to the integration certificates shall be expressly indicated in the table of the General Document-Index.
For the purpose of proving compliance with the requirements for the granting of the final authorisation, the provisionally authorised fixed odds betting operator shall submit a single specific online gaming certificate or a single online gaming certificate referring to games of a specific provider, expressly indicated in the table of the General Index Document.
Provisionally licensed fixed odds betting operators shall submit the General Index Document through the Gaming Management System (SIGAP) by 30 January 2025.
The General Index Document referred to in the header must be a single document, submitted as a document type ‘Gaming System Certificate’ and labelled ‘General Index Document’.
In the event that the required certification is not completed by 30 January 2025, the provisionally authorised fixed-odds bookmaker must submit through the Betting Management System - SIGAP: General Index Document with information on the certificates and a request for extension of the deadline accompanied by a statement from the certifying entity.
Provisionally authorised fixed-odds betting shops and permanently authorised fixed-odds betting shops must send a label (brand report) to certificates issued to several operators in which the operator's details do not appear explicitly, known as Business to Business (B2B) certificates.
The label must be the front page of the respective certificate sent and its sending does not exempt the provisionally authorised fixed odds bookmaker from sending the General Index Document and the Online Gambling Index Document.
Provisionally licensed fixed odds bookmakers and permanently licensed fixed odds bookmakers must submit a cover page (brand report) for certificates issued to multiple operators that do not explicitly include operator details, known as Business to Business (B2B) certificates.
The cover page must be the front page of the respective certificate submitted and its submission does not exempt the fixed odds bookmaker with a provisional licence from submitting the General Index Document and the Online Gaming Index Document.
