(Brasília).- Brazil’s Supreme Federal Court (STF) is holding a public hearing this Tuesday (November 3) to discuss the impact of Provisional Measure 1,394/2026, which bans the operation of fixed-odds betting, known as bets, and provides for the termination of authorizations granted to companies in the sector. Convened by Justice Luiz Fux, the hearing brings together representatives of the federal government, sports organizations, civil society groups and betting industry associations to provide technical and legal input for the Court’s consideration of the dispute.
STF Brings Government and Betting Industry Together to Discuss Ban
The public hearing was convened as part of Direct Action of Unconstitutionality (ADI) 8027, filed by the National Association of Games and Lotteries (ANJL). The organization challenges the constitutionality of the provisional measure and requests the immediate suspension of its effects, as well as a ruling recognizing the constitutionality of the laws regulating fixed-odds betting in Brazil.
The hearing was requested by the ANJL itself, the Office of the Attorney General (AGU) and organizations admitted to the proceedings as amici curiae.
The discussion takes place amid disagreements over the effects of the provisional measure, issued by the federal government, which provides for the suspension of the operation, offering and intermediation of the betting activities covered by the regulation, as well as the termination of authorizations granted to operators.
For the betting market, the discussion represents an important step in determining the future regulatory framework for the activity in Brazil. Key issues include legal certainty, the financial impact on companies, existing contracts and the consequences of a potential suspension of operations.
Government Agencies, Football Clubs and Industry Associations to Participate
The agenda includes representatives from different sectors, reflecting the broad scope of the debate surrounding sports betting in Brazil.
Government institutions taking part include the Office of the Attorney General (AGU), the Federal Prosecution Service (PGR) and representatives from the Ministries of Finance, Health, Justice and Sports.
The sports sector will also have a significant presence, with representatives from the Brazilian Football Confederation (CBF), the Brazilian Olympic Committee (COB), as well as executives and representatives from clubs such as Flamengo, Fluminense, Botafogo, Corinthians, São Paulo and Cruzeiro.
The betting industry will be represented by associations including the National Association of Games and Lotteries (ANJL) and the Brazilian Institute for Responsible Gaming (IBJR), both of which are involved in discussions about the impact of the ban and the future of the activity.
Hearing Participants Also Sparked Disagreements
The selection of participants prompted disagreements before the hearing. According to information published by Brazilian magazine VEJA, the AGU questioned the initial composition of the panel, arguing that it was dominated by representatives favorable to operators and football clubs.
Following the intervention, Justice Luiz Fux reorganized the list of participants in an effort to broaden representation of the different positions involved in the dispute.
Public Health and Legal Certainty Among Key Issues
In addition to the economic and regulatory implications, the hearing also addresses the potential social effects of betting.
Civil society groups and health organizations have raised concerns about the risks associated with gambling disorder, including excessive debt, mental health problems and family conflicts.
The discussion brings together different perspectives on the activity. On one side are concerns about the ban, the constitutionality of the measure and legal certainty for the market. On the other are calls for consumer protection and measures to prevent harm associated with problem gambling.
The participation of government, sports and industry representatives is intended to provide the STF with different elements to assess the effects of Provisional Measure 1,394/2026.
STF Has Not Yet Set a Date for Final Ruling
The purpose of the public hearing is to gather technical and legal information to support the Supreme Federal Court justices in their examination of the case.
The hearing does not constitute a ruling on the constitutionality of the provisional measure. Following the session, the case will continue through the proceedings of ADI 8027 and will need to be included on the agenda of the Court’s full bench for a final decision.
No date has yet been set for the final ruling.
The outcome of the proceedings could represent a milestone for the future of sports betting in Brazil, amid uncertainty for operators, suppliers, sports clubs and other participants in the industry.
