Ecuadorian President Guillermo Lasso banned the advertising of bookmakers in the country

(Quito).- As of the regulation of article 56 of the Organic Law of Communication, the advertising of bookmakers or sports predictions is prohibited in Ecuador. This change was signed by President Guillermo Lasso.

The situation opens the debate as to how applicable the regulation is, in a framework in which the spread of this type of companies, which advertise in the media, social networks and football team jerseys, is growing.

"Misleading advertising is prohibited, as well as any type of advertising or propaganda of child pornography, cigarettes, controlled substances and any type of betting system or sports predictions," says the recently regulated article 56.
"However, it clarifies that "beverages that do not exceed 5% alcoholic content may be advertised".

By order of President Lasso, the changes will take effect from the date of the signing of Executive Decree 853, signed on 23 August 2023, without prejudice to its publication in the Official Register.

The debate on implementation


In relation to sports lawyer Celso Vásconez, the scope of the ban is still unclear. The expert explained that the rule will be difficult to enforce, as it prevents sanctions.

Meanwhile, Giovanni Cárdenas, professor of sports law at the Pontifical Catholic University of Ecuador (PUCE), affirmed that article 56 of the regulation to the Communication Law signed by Lasso is general and refers to "all types of publicity". 

According to Cárdenas, while the article, as they are now, those agreements include advertising commitments. What is not clear, according to him, is whether these agreements will also be prohibited.
