New Jersey Governor Signs Sweepstakes Ban into Law

(New Jersey).- New Jersey Governor Phil Murphy has officially signed legislation banning the sweepstakes model of wagering in the state. The bill, designated A-5447, was signed into law on August 15 after being introduced in March and progressing through committee review in June.

New Jersey Governor Signs Sweepstakes Ban into Law

The new law aims to crack down on sweepstakes-style gambling by introducing stricter definitions and enforcement measures. It empowers the Division of Consumer Affairs and the Division of Gaming Enforcement to impose penalties on operators running unlawful gambling schemes, as part of a broader effort to eliminate legal loopholes and bolster consumer protections.

Under the law, sweepstakes are defined as promotional events where participants can win prizes. Any sweepstakes requiring payment or something of value to enter is now considered illegal gambling. Repeat violators could face civil fines of up to $250,000.

However, the legislation makes an exception for sweepstakes that provide a free method of entry, clearly disclose rules and odds, restrict participation by minors for prizes over $1,000, and ensure equal chances of winning regardless of how someone enters.

In addition to prohibiting certain sweepstakes practices, the law expands definitions of gambling and increases penalties for various gambling-related offenses.

With this move, New Jersey joins a growing list of states—including Connecticut, Montana, Nevada, and New York—that have banned the sweepstakes wagering model. Other states, such as Maryland, Florida, and Arkansas, have debated similar measures, though not all have advanced.
