Brazil Proposes a 15% Tax on Online Betting Deposits

In December 2025, Brazil’s Senate approved an amendment to Bill 5582/2025 that introduces a 15% tax on player deposits made on licensed online betting platforms, known as CIDE-Bets. Unlike traditional gambling tax frameworks, the levy is not applied to wagers placed or to operators’ gross gaming revenue (GGR), but instead at the moment a player transfers funds into a betting account, before any gambling activity takes place.

Although the measure must still be reviewed by the Chamber of Deputies and is therefore not yet law, its approval in the Senate sent a strong political signal. The tax is framed within Brazil’s anti–organized crime legislation and is presented as a dedicated funding source for the National Public Security Fund, with official projections suggesting substantial revenue generation—figures that have been met with skepticism by industry analysts.

For players, the impact would be immediate and highly visible: a R$100 deposit would automatically become R$85 in playable balance. This administrative deduction, applied repeatedly with every top-up, could particularly affect casual bettors and alter the perceived value of regulated platforms compared with illegal ones, where deposits would retain their full value.

From the operators’ perspective, industry bodies such as the National Association of Games and Lotteries (ANJL) and the Brazilian Institute of Responsible Gaming (IBJR) have warned that the tax risks distorting the market at a critical moment, as Brazil’s regulated betting sector is still in its first year of operation. By taxing the flow of funds rather than actual gaming revenue, the levy would sit on top of existing tax obligations, potentially eroding margins, disrupting bonus strategies, and weakening the competitive position of licensed operators against unregulated offshore platforms.

Beyond its commercial impact, the proposal is also facing legal scrutiny. Legal experts have raised concerns about its constitutionality, arguing that player deposits do not constitute operator income and that a fixed levy on deposits could be considered confiscatory in practice. Questions have also been raised about the legislative process itself, as the tax was introduced via an amendment to broader public security legislation.

With the bill still under review and the possibility of revisions, delays, or even legal challenges before Brazil’s Supreme Federal Court, the outlook remains uncertain. In the meantime, operators are being pushed to prepare for multiple scenarios, reassess payment flows, and develop clear player communication strategies to mitigate the potential impact of a measure that, if enacted, could significantly reshape Brazil’s online betting market.
