Japan advances toward illegal online casino blocking with government-backed policy framework

(Tokyo).- Expert panel endorses draft roadmap prioritizing stronger enforcement while weighing constitutional risks tied to communication privacy.
Japan is moving closer to implementing website blocking measures against illegal online casinos after a government expert panel endorsed a draft framework outlining stricter countermeasures.
The panel, convened by the Ministry of Internal Affairs and Communications, approved a report that proposes blocking access to offshore gambling sites as part of a broader enforcement strategy. The measure would require internet service providers to restrict access to domains identified as illegal, marking a significant escalation in the country’s regulatory approach.
Support for the proposal was strong among experts, particularly due to concerns over youth exposure. Panel member Noriko Tanaka highlighted the risks posed by illicit operators, noting the ease with which younger users can access such platforms.
However, the report stops short of recommending immediate implementation. Concerns remain around potential conflicts with constitutional protections, particularly the secrecy of communications, a fundamental right under Japanese law. Website blocking would require telecom operators to monitor user traffic destinations, raising privacy and legal challenges.
Currently, Japan only applies blocking measures in extreme cases such as child exploitation content. Expanding this mechanism to online gambling would represent a major policy shift.
The panel emphasized that blocking should be considered a last resort. Authorities are instead encouraged to first maximize existing measures, including removing social media content that promotes illegal casinos and coordinating with foreign jurisdictions to restrict access.
While these efforts have shown “a certain degree of effectiveness,” challenges persist. Research from Nomura Research Institute indicates that user access to overseas casino sites remains largely unchanged, and public awareness of the illegality of such platforms has plateaued at around 60%.
Experts are now calling for a careful, phased approach. Masahiro Sogabe of Kyoto University stressed that the framework is intended to guide future policy discussions, while University of Tokyo professor Joji Shishido described blocking as a “final step” that would require robust legal and technical safeguards before adoption.
