The regulation of advertising in betting comes into force in Spain

(Spain) .- The Royal Decree on commercial communications for gambling activities, which regulates advertising in the online betting and gambling sector in Spain, enters into force in its entirety this Tuesday, August 31, at end the period of adaptation to the new measures available to the affected companies. Among other changes, the regulations banish betting ads in audiovisual format to the time slot that runs from 1:00 a.m. to 5:00 a.m.
This category includes not only TV and radio, but also YouTube and other video-sharing platforms. Advertising on the Internet is relegated to the portals of the gaming companies and their profiles on social networks, where they can send advertising messages to their followers as long as there is consent from the recipient. Of course, both in search engines, social networks or video exchange platforms, operators must have instruments that guarantee that, in no case, their advertising is directed to minors and that there are mechanisms for blocking or hiding ads.
In addition, the new text adjusts the content of advertising messages with the intention of protecting the most vulnerable sectors and prevents gambling market operators from issuing player recruitment bonds, among other measures. According to Consumption, with the new regulation, companies will only be able to direct their offers to registered and verified customers and, in no case, to people who have shown pathological behaviors in gambling activity.
