CEOF Authorizes Banco de Brasilia to Create Subsidiary for DF Lottery

(Brasilia).- The Economics, Budget and Finance Committee (CEOF) of the Legislative Chamber of the Federal District (CLDF) approved, this Tuesday, an authorisation for Banco de Brasília (BRB) to create a subsidiary to take care of the future DF Lottery.
The text was approved by the members of the Commission and will continue to go through other commissions until it reaches the full House.
The authorisation is provided for in Executive Bill No. 1.081/2024, which amends Law No. 7.155/2022, which created the DF Lottery. According to the approved text, BRB is ‘authorised to create a subsidiary to carry out the operational activities inherent to the exploitation of lottery and similar games, including electronic gaming by physical and digital means’.
Change in ITBI calculation
The CEOF also approved bill no. 885/2024, by deputy Thiago Manzoni (PL), which amends the legislation that defines the basis for calculating the Tax on the Inter Vivos Transfer of Real Estate and Rights Relating Thereto (ITBI). The bill still needs to be analysed in other committees and on the floor of the CLDF.
Under the proposal, the tax base will now be ‘the market value of the property as measured by the transaction value declared by the taxable person’.
In the bill's justification, deputy Thiago Manzoni argued that in March 2022, the Superior Court of Justice (STJ) established that the ITBI calculation basis is the value of the property transferred under normal market conditions, and is not linked to the IPTU calculation basis, which cannot even be used as a tax floor.
