Dutch Gambling Authority Issues New Guidelines on Ban of Untargeted Advertising

(Netherlands).- The Dutch Gambling Authority (Ksa) has published new guidelines on the ban of untargeted advertising. With these guidelines, the Ksa provides remote gambling license holders with further clarification and practical tools to comply with the legal requirements for online advertising, with the aim of better protecting vulnerable groups from gambling ads.
Since the introduction of the ban on untargeted advertising, online gambling providers have only been allowed to advertise under strict conditions via the internet and on-demand media services. In practice, these conditions have raised questions among license holders.
With the new guidelines, the Ksa clarifies how these conditions should be interpreted and applied. The guidelines address, among other things, advertising via external platforms and third parties, offering a genuine option to refuse advertising, and how providers must document and substantiate their efforts and measurement results. The guiding principle is that online gambling advertising should not reach vulnerable individuals. In some cases, this may mean that a provider must refrain from advertising on a particular platform.
