Dominican Republic establishes guidelines for the online gaming industry

(Dominican Republic).- The Luck & Chance games industry is growing enormously worldwide, and the Dominican Republic is no exception. Technological advances, Internet penetration and regulatory advances are some of the factors that explain the growth of online games of luck and chance.

Dominican Republic establishes guidelines for the online gaming industry

That is why, last March 14 of this year, the Dominican Republic became the 6th country in Latin America to regulate games of luck and chance on the Internet, through Resolution No. 136-2024, promulgated by the Ministry of the Treasury.

The purpose of this resolution is to establish the legal, regulatory, technological requirements and administrative fees that must be met by any operator interested in obtaining an online gambling license, as well as to regulate the operating conditions of this type of gaming and the platforms through which they are offered to the public.

Furthermore, it is the first time that the responsible gaming program has been introduced and promoted in the Dominican Gaming Industry, which establishes the measures that the Operator must implement to encourage safe and healthy gaming.

Regarding the administrative fees to request the Internet Games & Luck license, the Regulator has decided to divide its fees into three items, that is, to operate an Online Casino, the established rate is US$363,000.00, while that of bets on professional sports will be US$265,000.00 and a third type of other games for an amount of US$185,000.00.

The validity of each of these licenses will be five years, renewable for the same period and non-transferable during the first three years of operation.

It is good to mention that, in the tax aspect, the operator, as established by Law 139-11, will be obliged, among other fiscal commitments, to the monthly payment of 10% based on the gross operations or sales from all the games that are done online.

However, there is undoubtedly room for expansion as more and more people become accustomed to shopping online and look for easy methods to play and bet.

In the Dominican Republic, 90% of the population has a smartphone and access to the internet. That is why the growth projection of online gambling will significantly increase the scope and breadth of the industry beyond casinos, authorized sales points and traditional physical Sports Betting Banks, attracting operators foreigners to the Dominican market.

It is no secret that the best companies in the gaming industry are always looking for expansion, and there is nothing better than this opportunity to make their debut in the country.

I am sure that the Dominican Republic will end up being among the main Suerte & Chance gaming countries with legislation in line with international guidelines, which will lead to greater security for local and foreign operators, as well as users. Yamile Gutiérrez expressed

The ceiling has not been reached and there is still a lot of room for legal and regulatory growth ahead for the Luck & Chance gaming industry in the Dominican Republic. However, little by little, regulatory measures are being issued, which seeks to position the country, among the best regulated in the gaming industry in Latin America.

We hope that, this year, the law for the Games of Luck & Chance sector will be submitted to the National Congress.

Yamile Gutiérrez is a founding partner of G&G Studio Legal, the first legal firm in the Dominican Republic specialized in legal, regulatory and tax matters in the Gaming sector, and had a great presentation at the GAT Expo Cartagena 2024 event last March, highlighting the firm's commitment to excellence and deep knowledge of the complex legal and regulatory environment that surrounds this industry, and contacting leaders in the international gaming sector.
