(New Jersey).- A new bill introduced in the New Jersey Legislature would prohibit casinos and sportsbooks from sending text messages or push notifications aimed at encouraging customers to place bets or replenish their accounts. The proposal includes financial penalties of $500 per violation and reflects growing scrutiny of direct-to-consumer marketing practices in the regulated gaming sector.

The legislation was introduced Monday by State Senator Andrew Zwicker (D–Hunterdon, Mercer, Middlesex, Somerset). If enacted, it would specifically target digital communications designed to prompt immediate wagering activity or additional deposits.

Focus on Direct Digital Triggers

According to Zwicker, the measure is narrowly tailored to address two specific types of outreach: messages prompting customers to “place a wager” or “replenish an account.”

“It’s specific to text messages and push notifications to place a wager or replenish an account, two things that studies have shown can contribute to gambling addiction,” Zwicker said.

The bill does not broadly ban all forms of advertising or marketing communications from licensed operators. Instead, it concentrates on real-time, direct messaging channels that can instantly reach customers on their mobile devices — a key engagement tool for both online casinos and sportsbooks operating in the state.

Potential Impact on Marketing Strategies

New Jersey is one of the most mature and competitive regulated gaming markets in the United States, with operators relying heavily on digital acquisition and retention strategies. Push notifications and SMS campaigns are commonly used to promote bonuses, highlight live betting opportunities, and encourage re-engagement during major sporting events.

If approved, the proposed restrictions could prompt operators to reassess their customer communication strategies in the Garden State, potentially shifting greater emphasis toward email marketing, in-app advertising not classified as push notifications, or broader brand campaigns.

The bill’s introduction comes amid ongoing national discussions about responsible gambling safeguards and the balance between commercial freedoms and consumer protection. While it remains under legislative consideration, the measure signals that marketing practices — particularly those leveraging instant mobile contact — are likely to face increasing regulatory attention in established U.S. jurisdictions.
